Terms & Conditions
These Terms & Conditions apply to all services provided by Atascocita Photography (“Photographer” or “Instructor”), including portrait sessions, mini-sessions, event photo stations, and photography education services.
By booking any service, you acknowledge that you have read, understood, and agree to the following terms.

I. GENERAL TERMS (APPLY TO ALL SERVICES)
1. Booking & Payment
A session, event, or class is not confirmed until payment has been successfully processed.
All retainers and session fees are non-refundable. Your reserved date and time are held exclusively for you and removed from availability for other clients.
Sales tax applies where required by law.

2. Rescheduling
Unless otherwise stated in a specific service section below:
• One reschedule is permitted with proper notice.
• Rescheduled services must occur within 90 days of the original date.
• Additional rescheduling may require a new booking and payment.
Failure to reschedule within 90 days may result in forfeiture of payment.

3. Cancellations & No-Shows
Cancellations or failure to appear for a scheduled service result in forfeiture of payment.

4. Editing & Artistic Style
All images are edited in Atascocita Photography’s signature bright, colorful style.
Standard editing includes exposure, color, and cropping adjustments.
Advanced retouching may be available for an additional fee.
Final artistic discretion remains with the Photographer.

5. Image Delivery & Storage
Digital images are delivered via online gallery unless otherwise specified.
Clients are responsible for downloading and backing up files promptly.
Atascocita Photography does not guarantee long-term archival storage.
Unpurchased or unselected images may be permanently deleted and cannot be retrieved.

6. Copyright
All images remain the copyrighted property of Atascocita Photography.
Purchased digital images include personal-use rights only.
Images may not be altered, filtered, edited, resold, submitted to contests, or used commercially without prior written permission.

7. Model Release
Unless declined in writing prior to the session or event, Atascocita Photography may use select images for portfolio display, website content, advertising, and social media.

8. Limitation of Liability
If services cannot be performed due to illness, emergency, equipment failure, act of God, venue restrictions, or circumstances beyond reasonable control, Atascocita Photography’s liability is limited to the return of payments made for the affected service.
Atascocita Photography shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to emotional distress, loss of opportunity, or third-party claims.

9. Governing Law
This agreement is governed by the laws of the State of Texas. Any disputes shall be resolved in Harris County, Texas.

10. Contact Consent
By booking, you consent to being contacted via phone, text message, email, or mail regarding your service and related offerings. You may opt out of marketing communications at any time.

II. PORTRAIT & FULL SESSIONS
Package & Payment
Your portrait package includes the session and the number of digital images listed at booking.
Additional digital images, full gallery upgrades, or printed products may be purchased after viewing your gallery.
Full payment is required at booking unless otherwise stated.

Rescheduling
One reschedule permitted with at least 48 hours’ notice.
Outdoor sessions affected by inclement weather will be rescheduled at no additional charge.
If illness occurs within your household, please notify us promptly to arrange rescheduling.

Late Arrivals
Arrivals more than 15 minutes late may result in a shortened session.
Arrivals more than 20 minutes late may be considered a no-show.

Image Selection & Ordering
Online galleries remain active for 7 days unless otherwise specified.
If selections are not made within 30 days, the Photographer may select included images and close the gallery.
Downloaded galleries remain active for approximately 2 months.

Studio Sessions (Home Studio)
Clients must supervise all children at all times.
Clients assume responsibility for personal safety and for any damage caused to studio property by themselves or accompanying guests.
Atascocita Photography is not responsible for accidents, injuries, or loss of personal property occurring on the premises.

III. MINI SESSIONS
Mini sessions are event-based and time-limited.
Mini-session fees are non-refundable and may not be rescheduled unless illness or emergency is approved by the Photographer.
If illness occurs, payment may be applied toward a future mini-session event or full session within 30 days, subject to availability.
If the event must be rescheduled due to weather or circumstances beyond control, an alternate date or indoor option will be provided. Refunds are not issued if an alternate option is offered.
No-shows result in forfeiture of payment.
Image delivery timelines and ordering procedures will be as stated in the booking description.

IV. EVENT PHOTO STATION
Pricing
Event photo station pricing is calculated as the hourly rate multiplied by the number of reserved hours.
Full payment or required retainer is due to confirm your event date.

Rescheduling
One reschedule permitted with at least 72 hours’ notice.
Rescheduled events must occur within 90 days of the original date.
Failure to communicate within 90 days may result in forfeiture of payment.

Venue Requirements
The photo station must be set up indoors in a climate-controlled environment.
Client is responsible for securing venue permission and providing adequate setup space.

Gallery & Delivery
Digital images are delivered via online gallery and remain active for 60 days.
Clients are responsible for downloading and backing up images promptly.
Photo station images are edited for exposure and color correction. Advanced retouching is not included.

V. PHOTOGRAPHY EDUCATION & WORKSHOPS
Enrollment & Payment
Class fees are due in full prior to the class start time and are non-refundable.
Enrollment is not reserved until payment and required forms have been submitted.

Cancellations
Student cancellations are non-refundable.
If the Instructor cancels due to unforeseen circumstances, students will be offered either a rescheduled date or a full refund.

Conduct
Disruptive, unethical, or disrespectful behavior may result in removal without refund.
Late arrivals may miss content and will not receive partial credit or refund.

Intellectual Property
All class materials, slides, handouts, videos, and instructional content are the property of the Instructor and may not be copied, recorded, distributed, or shared without prior written permission.
Recording of classes is prohibited unless authorized in writing.

Non-Compete & Location Restrictions
Students agree not to offer or conduct photography sessions, mentoring, workshops, styled shoots, or education services in Humble, Atascocita, or Kingwood for a period of 12 months following the class date without written permission.

Liability Waiver
Participation in education services is at your own risk. The Instructor is not responsible for injury, equipment damage, or business outcomes resulting from participation.

Final Agreement
By booking any service with Atascocita Photography, you confirm that you have read and agreed to these Terms & Conditions.
